On September 28th, The Centers for Medicare & Medicaid Services (CMS) announced a Special Enrollment Period (SEP) for those affected by recent Federal Emergency Management Agency (FEMA) declared emergencies or major disasters. CMS also announced an extension of the Annual Election Period (AEP) for individuals impacted by a FEMA-declared emergency. Below is how Texas Residents will be affected by the SEP.
• Allows individuals affected by these declared emergencies or major disasters to enroll, dis-enroll or switch Medicare health or prescription drug plans in the event they were eligible but unable to make an election before the disaster occurred.
• Is available to individuals who reside in an affected area, or resided in an affected area at the time the disaster was declared, but have since moved.
The Texas counties affected by the SEP are: Brazoria, Chambers, Ft. Bend, Galveston, Hardin, Harris, Jasper, Jefferson, Liberty, Montgomery, Newton, Orange, Polk, San Jacinto, Tyler, Walker, and Waller.

When I was 21, I planned to be a lawyer when I grew up. I needed a job right then, however. I started working for a small insurance company, then a larger one, then an agency. One of the part time jobs I had picked up in college (one of many I juggled) ended up keeping me employed for 5 years, unintentionally. In 2013, the Patient Protection and Affordable Care Act went into effect. The industry had fought and lobbied for and against the law. There was fear, apprehension and hope as the changes took place. I wanted to help people, I was excited, maybe it would open doors to people who were pushed out of plans for falling outside of the perfect guidelines required of the insurance carriers. I decided that this would be what I would concentrate on full time, to start the roll out strong.
2013: The first year. Open Enrollment lasted 6 months, the deadline was extended several times to allow those who didn’t trust the system yet to catch up. There were a variety of issues and appeals were common, and took months, but eventually were resolved.
2014: The second year. Open enrollment was scheduled for 3 months. Again the deadline was extended an additional 6 weeks to accommodate those who waited until the last minute since the system could not handle the sudden volume,
2015: The third year. Open enrollment was scheduled for 3 months, and was not extended. PPOs were withdrawn from Healthcare.gov, health carriers started to withdraw from markets completely. When the federal and state regulators required carriers to stay, several decided to stop offering individual health coverage at all.
2016: The fourth year. Open enrollment continued as scheduled for 3 months, even though the results of the presidential election caused people to believe that Obamacare would be cancelled. New companies that had been founded and counted on the risk corridors established at the beginning started to close as the original funds expired and were not reauthorized. Again there were issues and appeals, now those appeals were denied more quickly. Any issues that caused a plan to be cancelled, did not allow a reinstatement. One or two carriers were all that was left on Healthcare.gov for anyone not in an urban/suburban area.
2017: The fifth year, here we are. Open enrollment was shortened to more or less the same length as the Medicare Annual Election Period, but no one was prepared. Fewer options, and fewer companies are available, and no one knows what next year will bring. The news constantly talks about cuts and changes and no ones knows if “next year” is 2018 or 2019 without looking for the often omitted sources.
No extensions will be given, December 15th is the deadline. There are less than 3 days left.
Appeals and Special Enrollment Periods are available, but will be difficult and heavily scrutinized. Don’t wait for the last minute if you depend on coverage. The industry has been irrevocably changed, repeal will not return health insurance to “normal.” There is no normal. We have to move forward, and improve. I can’t predict what will really happen. My goal remains the same; help those looking for coverage to understand what is available and what they can use to live better, healthier lives.
10 years past unexpectedly, I didn’t grow up to be an attorney. I wonder what the next 10 years will bring.
