Whitten & Whitten

If you are suffering under the pressure of mounting unpaid bills and calls from creditors, we CAN HELP!

Generally, the bankruptcy process assesses the debtor’s assets and liabilities and provides a structure within which the debtor is allowed to keep some, and in most cases, all property and ordered to satisfy as many eligible debts as possible, according to an order of priority established by law. Remaining debts are discharged, except those of certain types, like domestic support orders, debt obtained by fraud and most tax debt.

What Not to Do Before Bankruptcy

If you are going through the steps to free yourself from debt with bankruptcy, please do not do the following.

How Do I Prepare for Bankruptcy? | Upsolve

Preparing to file for bankruptcy? This is what you need to know.

upsolve.org It may be helpful to take these steps to prepare for filing for bankruptcy, whether you're working with a bankruptcy attorney or filing on your own online.

Once I file bankruptcy, will the harassing calls stop?

Yes! When you file a bankruptcy, in almost every case, the bankruptcy court will issue an order to your creditors which prevents them from continuing any collection efforts against you outside of the bankruptcy court. Moreover, in almost every case, once you have filed for bankruptcy the court orders that all garnishments, home foreclosures, and car repossessions are suspended.

"I haven't kept good records. Can I still declare bankruptcy?"

Generally not. Once you come into the office we can run a credit report for you which should provide us with the information that we need. However, you must remember, that it will finally be your responsibility to list ALL of your creditors and debts. If you leave off or omit a creditor, that debt will not be discharged and you will ultimately be responsible for it. This is why it is so important to speak with an Attorney if and when you are first considering bankruptcy.

Bankruptcy has become a common and accepted way to take action to solve your problems. As your financial situation improves, you can reestablish credit, and get on with your life.

Bankruptcy can provide a fresh start. If you don’t file because you are worried about being embarrassed, you could be making a big mistake.

Can I go to jail if I file for bankruptcy?

NO. If you tell the truth and disclose all that is required there is no chance you will go to prison. There are, however, instances of threats of prison based on bankruptcy fraud. This is a serious federal offense! Don’t try to “scam” the system by lying or “strategic omissions.”

Before making a decision to declare bankruptcy, you may want to consider other alternative options. But be careful though – if your financial problems are long term, or if all your creditors will not agree to work with you, bankruptcy may be the best way for you to get out from under a big debt load and get a fresh start. No matter what course you take, you should see an attorney to figure out the best solution for your situation.

"Will I lose my retirement and 401K if I file for bankruptcy?"

No. The bankruptcy courts have provided rights and exemptions for individuals so they may keep their retirement pensions and 401Ks. In fact, by filing bankruptcy an individual can actually protect their retirement better if they have not filed.
